EmVe ("the Service") is a web-based employee background verification service platform developed, maintained, and supported by Infanion Software Solutions India Private Limited ("Infanion", "we", "us", or "our"). By accessing or using EmVe, you agree to be bound by these Terms and Conditions ("Terms").

EmVe Portal Concept:
EmVe is a portal concept provided to various companies ("Partner Companies") who use it to offer employee background verification services. Each Partner Company has its own instance of the EmVe portal. When you access an EmVe portal, you are using the platform to request background verification for employees or ex-employees of the specific Partner Company whose portal you are accessing. For example, if you are requesting a background verification for an ex-employee of Partner Company X, you would use the EmVe portal specifically set up for Partner Company X.

1. Acceptance of Terms
   By accessing or using EmVe, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not use our Service.
2. Service Description
   1. EmVe provides a platform for employee background verification for individuals or businesses upon request and payment.
   2. The scope of verification may include, but is not limited to, relieve letter verification, employment verification, payslip verification, employment history, educational qualifications, as permitted by applicable Indian laws.
   3. EmVe and Infanion do not guarantee employment or make hiring decisions. Our role is limited to providing the platform for verification information.
3. User Responsibilities
   1. Information Accuracy: You agree to provide accurate, current, and complete information as required for the Service.
   2. Consent: You must obtain explicit written consent from the subject of the background check before submitting a request, in compliance with the Information Technology Act, 2000 and other applicable Indian laws.
   3. Legal Compliance: You are responsible for using the information obtained through our Service in compliance with all applicable Indian laws, including but not limited to the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and relevant employment laws.
   4. Account Security: If you create an account, you are responsible for maintaining the confidentiality of your account and password
   5. Age Restriction: You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement.
   6. Compliance with Employment Laws: Users are responsible for ensuring that their use of our Service complies with all applicable Indian employment laws, including but not limited to the Equal Opportunity Act and prevention of workplace discrimination regulations.
4. Payment
   1. Fees: Our fees are as listed on the respective Partner Company's EmVe portal and may change without notice. All fees are in Indian Rupees (INR). 
   2. Payment Timing: Payment is due at the time of submitting a background verification request. 
   3. Refunds: All payments are non-refundable unless otherwise required by Indian law. 
   4. Taxes: All fees are including applicable taxes
   5. Cancellations: once an order has been paid, it cannot be cancelled.
5. Privacy and Data Protection
   1. We collect, use, and protect personal information as described in our Privacy Policy, in compliance with Indian data protection laws.
   2. By using our Service, you agree to our data collection and use practices.
   3. We comply with the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 in processing personal information.
   4. Data Retention: We retain personal data only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable Indian laws. After this period, we will securely delete or anonymize the data.
   5. Cross-Border Data Transfer: If we transfer any personal data outside India, we ensure compliance with the applicable data protection laws and regulations of India, including obtaining necessary consents and implementing appropriate safeguards.
6.  Aadhaar Usage
   If our Service utilizes Aadhaar for verification purposes, we comply with the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 and related regulations. Users must provide consent for Aadhaar-based verification as per legal requirements.
7. Disclaimers
   1. No Guarantee: While we strive for accuracy, we do not guarantee the completeness, timeliness, or accuracy of any information provided through our Service.
   2. User Responsibility: Users are solely responsible for their decisions and actions based on information obtained through our Service.
   3. Third-Party Information: Some information may be obtained from third-party sources, for which we assume no responsibility.
   4. Service Availability: While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to our Service. We are not liable for any service interruptions due to technical issues, maintenance, or factors beyond our control.
8. Limitation of Liability
   1. To the fullest extent permitted by Indian law, our liability for any claim arising out of or related to these Terms shall not exceed the amount you paid for the Service. 
   2. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
9. Intellectual Property 
   1. All content, features, and functionality of our Service are owned by us or our licensors and are protected by Indian copyright, trademark, and other intellectual property laws.
   2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Service without our prior written consent.
10. User Content
    By submitting any content to our Service, you grant us a non-exclusive, royalty-free license to use, modify, and display that content for the purpose of providing our Service.
11. Termination
    1. We reserve the right to terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason.
    2. Upon termination, your right to use the Service will immediately cease.
12. Governing Law and Jurisdiction
    1. These Terms shall be governed by and construed in accordance with the laws of India.
    2. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in [insert specific city/state in India].
13. Dispute Resolution
    In the event of any dispute arising out of or relating to these Terms, the parties shall first attempt to resolve the dispute through good faith negotiations. If unsuccessful, the dispute shall be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

    1. We reserve the right to modify or replace these Terms at any time.
    2. Your continued use of the Service after any changes constitutes your acceptance of the new Terms
15. Indemnification
    You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses arising out of your use of our Service or violation of these Terms.
16. Severability
    If any provision of these Terms is found to be unenforceable or invalid under Indian law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Confidentiality
    You agree to maintain the confidentiality of any information obtained through our Service and use it solely for the intended purpose of employment verification.
18. Force Majeure
    We shall not be liable for any failure to perform our obligations under these Terms if such failure is due to causes beyond our reasonable control, including but not limited to natural disasters, acts of government, or internet disruptions.
19. Partner Companies and Portal Usage
    1. Portal Specificity: Each EmVe portal is specific to a Partner Company. When you use a particular EmVe portal, you are requesting services related to that specific Partner Company.
    2. Information Responsibility: The Partner Company is responsible for the accuracy and management of the information provided through their EmVe portal, in accordance with their policies and applicable laws.
    3. Additional Terms: Partner Companies may have additional terms or requirements for using their EmVe portal. These will be clearly communicated on the respective portal and must be adhered to in addition to these Terms and Conditions.
    4. Service Provision: While Infanion provides the EmVe platform, the actual background verification service is offered by the Partner Company whose portal you are using.
    5. Liability: Infanion is not responsible for the actions, policies, or practices of Partner Companies using the EmVe platform. Any disputes or issues related to the verification process or results should be addressed with the relevant Partner Company.
    6. Data Handling: Infanion handles all data in accordance with our privacy policy and applicable laws. However, Partner Companies may have their own data handling policies which apply to the information processed through their EmVe portal.

21. Entire Agreement
    These Terms constitute the entire agreement between you and Infanion regarding EmVe and supersede all prior agreements and understandings.
