EmVe ("the Service") is a web-based platform for employee background verification requests and new hire onboarding, developed, maintained, and supported by Infanion Software Solutions India Private Limited ("Infanion", "we", "us", or "our"). By accessing or using EmVe, you agree to be bound by these Terms and Conditions ("Terms").

EmVe portal concept:
EmVe is a portal concept provided to various companies ("Partner Companies") who use it to offer employee background verification requests and onboarding services. Each partner company has its own instance of the EmVe portal. When you access an EmVe portal, you are using the platform to request background verification for employees or ex-employees or to initiate onboarding for new hires of the specific partner company whose portal you are accessing. For example, if you are requesting a background verification for an ex-employee of partner company X or onboarding a new hire, you would use the EmVe portal, specifically set up for partner company X.

1. Acceptance of terms
   By accessing or using EmVe, you agree to be bound by these terms. If you disagree with any part of the terms, you may not use our service.
2. Service description
   1. EmVe provides a platform for employee background verification requests and onboarding services for individuals or businesses upon request and payment.
   2. The scope of background verification requests may include, but is not limited to, relieving letter verification, employment verification, payslip verification, employment history, and educational qualifications, as permitted by applicable Indian laws.
   3. The onboarding service is a token-based digital workflow to streamline the joining process for new hires, including document uploads, policy acknowledgment, and task completion.
   4. EmVe and Infanion do not guarantee employment or make hiring decisions. Our role is limited to providing the platform for background verification requests and onboarding.
3. User responsibilities
   1. Information accuracy: You agree to provide accurate, current, and complete information as required for the service.
   2. Consent: You must obtain explicit written consent from the subject of the background verification request or onboarding process before submitting a request, in compliance with applicable Indian laws.
   3. Legal compliance: You are responsible for using the information obtained through our service in compliance with all applicable Indian laws.
   4. Account security: If you create an account, you are responsible for maintaining the confidentiality of your account and password.
   5. Age restriction: You must be at least 18 years old to use our service.
   6. Compliance with employment laws: You are responsible for compliance with Indian employment laws when using our service.
4. Payment
   1. Fees: Our fees are listed on the partner company’s EmVe portal and may change without notice.
   2. Payment timing: Payment is due at the time of submitting a background verification request or onboarding request.
   3. Refunds: Payments are non-refundable unless required by law.
   4. Taxes: All fees are inclusive of applicable taxes.
   5. Cancellations: Paid orders cannot be cancelled.
5. Privacy and data protection
   1. We handle data according to our Privacy Policy and Indian laws.
   2. By using EmVe, you consent to our data use practices.
   3. We comply with all applicable IT and data protection laws.
   4. Data retention: Personal data is retained only as long as necessary and is deleted or anonymized afterward.
   5. Cross-border transfer: Any data transferred outside India complies with Indian legal requirements.
6. Aadhaar usage
   If Aadhaar is used for verification, it is done by Aadhaar laws and with proper user consent.
7. Disclaimers
   1. No guarantee on completeness or accuracy of information.
   2. Users are responsible for decisions made using the service.
   3. We are not responsible for third-party data.
   4. Service availability is not guaranteed.
8. Limitation of liability
   1. Our liability is limited to the amount paid for the service.
   2. We are not liable for indirect or consequential damages.
9. Intellectual property
   1. All service content is protected by IP laws.
   2. You may not copy, reuse, or publish any material without permission.
10. User content
    By submitting content, you grant us the right to use and display it to fulfill the service.
11. Termination
    1. We may suspend access at any time without notice.
    2. Your right to use the service ends immediately upon termination.
12. Governing law and jurisdiction
    1. These terms are governed by Indian law.
    2. Disputes will be handled in the courts of [insert jurisdiction].
13. Dispute resolution
    Disputes should be resolved via negotiation and, if needed, arbitration under the Arbitration and Conciliation Act, 1996.

    Information accessed via EmVe should be used only for verification or onboarding and must be kept confidential.
18. Force majeure
    We are not liable for service delays or failures due to factors beyond our control.
19. Partner companies and portal usage
    1. Each EmVe portal is linked to a specific partner company.
    2. Partner companies are responsible for their data accuracy.
    3. Additional partner company terms may apply.
    4. Actual services (verification or onboarding) are provided by the partner company.
    5. Infanion is not liable for partner company practices or policies.
    6. Partner companies may have their own data handling policies.
